Section 94
Functions, Duties and Rights of the Office

(1) The work, duties and rights of the office shall be as follows:-
(a) To monitor the implementation of the minimum wages, allowances or benefits to be obtained according to the collective agreement and the rights granted to the workers and employers by the prevailing Nepalese law, as determined in accordance with this Act,
(b) To regularly monitor and give necessary instructions to the relevant parties to implement this Act and the rules made under this Act. (c) Provide training on standards and codes of conduct made in accordance with this Act and other laws in force related to labor and regularly monitor whether the standards and codes of conduct have been implemented,
(d) To provide necessary technical assistance to workers and employers for providing necessary training, if requested (e) instructing the employer to provide occupational safety and health standards or staff regulations or other necessary related documents,
(f) To implement collective agreements between employers and workers and decisions made by arbitrators,
(g) If children are found to be employed after inspection and found to be employed, to immediately rescue them and take action against such employers,
(h) To inspect whether the employer has implemented the provisions related to occupational safety and health as per paragraph-12 in the establishment and workplace,
(h) To observe or inspect the devices, tools, equipment or goods or substances connected to the workplace and to check whether such devices, tools, equipment, goods or substances are of the prescribed level and if testing is required, to collect samples thereof,
(j) Periodical or casual inspection of the establishment or workplace,
(k) To order the concerned establishment or the official of the establishment to provide any register, writing, document including the electronic record in the establishment or workplace and if such establishment or work is not provided,Entering the site and taking possession of the entire register, writing or document or a copy thereof,
(l) Obtaining information or information on necessary matters from employers, workers in the managerial category of the establishment or other workers,
(D) If deemed necessary, the employer, the workers of the managerial category of the establishment or other workers are present in the office and take statements,
(d) When inspecting the workplace or establishment or from any other source, if it is known that the employer or worker or trade union has acted contrary to this Act and the rules made under this Act, to give necessary instructions to correct such act immediately,
(n) Keeping records of applications or documents received in the office or information received from any other source, providing copies of such applications and documents, keeping records of decisions, orders and reconciliations made by the office or providing certified copies to anyone who requests a copy of any document, > (p) To do other work that is said to be done by the office according to this Act and prevailing Nepalese law, or
(th) To perform other tasks as specified.
(2) When using the authority under this section, the office may request the local administration, police or related agencies to provide such assistance if it is deemed necessary to take the assistance of the local administration, police or any other agency.
(3) If assistance is requested according to sub-section (2), it shall be the duty of the local administration, police and related agencies to provide such assistance to the office.
